Lexemica

Terms of Use

These terms govern the use of Lexemica in the app (iPhone and Android) and on the web (lexemica.com). By creating your account or using Lexemica you accept them, together with the Privacy Policy, which explains what we do with your data. If you don’t agree, please don’t use the service.

In short

  • Lexemica is for learning languages by speaking: use it for that, respectfully and for yourself.
  • The free plan has limits that the app shows you. Pro is a subscription that renews automatically until you cancel it.
  • On the web you pay through our payment platform and, if you are a consumer in the EU, you have 14 days to withdraw. In the app you buy from your app store, under its rules.
  • AI sometimes gets things wrong: the score and the level are a help for practising, not an official assessment.
  • What you record and write is yours. What you share by link can be seen by anyone with the link, until it expires or you stop sharing it.

1. Who provides the service

Lexemica is a service of Amberwake, operated by Mario Martinez. In these terms, “we” means the operator and “you” means whoever uses Lexemica.

2. The service

Lexemica is an app for learning languages by speaking. You practise with scenarios of real situations, from beginner to advanced, in which the app speaks to you and you answer out loud; what you learn comes back in a spaced review, also spoken. Your voice is transcribed in real time and the app compares what you said with what was expected.

Among other things, it includes a level test, your vocabulary, grammar explanations, sharing what you practise by link and, with Pro, creating custom scenarios with AI. Features may change over time (see Availability and changes).

To speak with Lexemica you need a microphone and an internet connection. On the web it works on a computer with an up-to-date browser; on a phone, with the app.

3. Your account

  • When you start, an account tied to your device is created. To take the level test at the start, keep your progress or use it on other devices, you add your email: you sign in with a code or a link we send you, without a password.
  • You must be at least the minimum age set out in the Privacy Policy.
  • Your account is personal. Look after access to your email: anyone who can read it can sign in to your account. If you think someone has signed in, sign out of the other devices in Settings › Devices and write to us.
  • If, on a device without an email, you sign in with an email that already had an account, you continue with that account and the progress that device had without an email is discarded.
  • You can delete your account at any time in Settings. Deleting it erases your progress and can’t be undone.

4. The free plan

You can use Lexemica for free with limits (for example, on the scenarios you can do, the reviews each day or the vocabulary you can see). The app always shows you what the free plan includes and when you reach a limit.

We may change what the free plan includes. You will see it in the app before it affects you, and it doesn’t change anything you have already paid for.

5. Lexemica Pro

Pro is a monthly or annual subscription that removes the limits of the free plan and adds features, such as creating custom scenarios (with a monthly allowance). The app and the website show what it includes and its price before you pay. Pro goes with your Lexemica account: you have it in the app and on the web, wherever you bought it.

On the web

  • You need an account with an email. The payment is handled by our payment platform, which acts as the seller (merchant of record): it charges you in your currency and applies the taxes of your country. You see the final price, taxes included, before you pay.
  • There is no free trial on the web.
  • The subscription renews automatically at the end of each period (month or year) and is charged to the same payment method, until you cancel it.
  • Cancelling: in Settings › Subscription › Manage subscription, whenever you like. You keep Pro until the end of the period you have paid for and it doesn’t renew again.
  • If a renewal payment fails, Pro is paused until you update your payment method.
  • If you delete your account, the web subscription is cancelled at that moment, without a refund for the current period (except for withdrawal, below).

In the app

  • Subscriptions in the app are sold and charged by the App Store (Apple) or Google Play (Google), under their terms. They are managed and cancelled in the store: on iPhone, in Settings › your name › Subscriptions; on Android, in Google Play › Payments & subscriptions.
  • If the app offers you a free trial, the paid subscription starts when it ends unless you cancel it earlier in the store.
  • Deleting your Lexemica account doesn’t cancel a store subscription: cancel it there.

Price changes

If we change the price of Pro, we will tell you in advance and the new price will only apply from your next renewal; you can cancel before then if you are not interested. App stores may also ask you to accept the change.

6. Withdrawal and refunds

Web subscriptions: 14 days to withdraw

If you are a consumer in the European Union (or in another country with an equivalent right), you have 14 calendar days from the day you subscribe to Pro on the web to withdraw without giving any reason. To do so, use the contact form with the email of your account; a clear statement that you want to withdraw is enough.

We will refund everything you paid for that subscription, using the same payment method, within 14 days of you telling us, and the subscription will end.

Purchases in the app

Withdrawal and refunds for purchases made in the App Store or Google Play are governed by that store’s terms and are requested from it (for the App Store, at reportaproblem.apple.com; for Google Play, from your order history). We can’t refund App Store purchases.

Other refunds

Outside withdrawal, cancelling stops the next renewal but doesn’t refund the current period, unless the law requires it or the service didn’t work for reasons attributable to us. If you have a problem with a charge, please write to us before disputing it with your bank: we will sort it out as soon as possible.

7. Acceptable use

Lexemica is for your personal learning. You may not:

  • use it for anything unlawful or that infringes the rights of others;
  • create scenarios with sexual, violent or hateful content, content involving minors, content that encourages self-harm or crime, or personal data about other people;
  • record or share someone else’s voice without their permission, or impersonate anyone;
  • write offensive messages, spam or personal data in other people’s reports;
  • extract Lexemica’s content in an automated or large-scale way, use it to train other AI systems or resell it;
  • circumvent the limits of the free plan, the allowances or the payments, or interfere with the operation or security of the service (including trying to access other people’s accounts or data, or decompiling the app except where the law allows it).

If you breach these terms we may remove the content concerned and suspend or close your account. Except in urgent cases or where others are at risk, we will tell you beforehand and explain why. If you had Pro and we close the account for a serious breach, the current period is not refunded.

8. Your content

Your content is what you contribute: your recordings, what you write or dictate (for example, the description of a scenario) and your display name. It remains yours. You allow us to use it only as far as needed to provide the service: transcribing it, scoring it, generating your scenario and serving your reports to whoever has the link. That permission ends when you delete it or delete your account, except for what others have already seen.

What you share by link

A shared report or your test result can be opened by link, without an account: anyone who has it can listen to your recordings, see your display name, type what they understand and rate your pronunciation. You decide who you give it to. The link expires after 30 days and you can stop sharing it earlier; it then stops working and its recordings are deleted. What listeners write is anonymous and is there so you can see what was understood.

Scenarios created with AI

The scenario that AI generates from your description is for your use within Lexemica. It may resemble other scenarios and we don’t guarantee that it is original or accurate. The generation may reject a description that doesn’t comply with these terms.

9. AI and its limitations

  • Speech recognition can make mistakes, especially with noise, strong accents or a poor microphone. The score compares what was recognised with what was expected: it is not a phonetic analysis or a judgement of your pronunciation.
  • The level test gives an estimate based on the CEFR levels (A1–C2). It is not a certificate or an official assessment.
  • Part of Lexemica’s content (sentences, translations, explanations, voices and illustrations) was created with the help of AI, as are the scenarios you create. The voices are synthetic. There may be mistakes or unnatural expressions: if you find one, let us know.
  • Lexemica is a tool for practising. Don’t rely on it as your only source in situations where a mistake has consequences (medical, legal, safety).

10. Intellectual property

The app, the website, their design, their software, the Lexemica brand and the content we offer (scenarios, sentences, audio, illustrations and texts) belong to us or to those who license them to us. We give you a personal, non-exclusive and non-transferable licence to use them within Lexemica as long as you comply with these terms. You may not copy, distribute or exploit them outside the service without permission.

If you send us suggestions, we may use them to improve Lexemica without any obligation to you.

11. Availability and changes

We work to keep Lexemica running well and without interruptions, but there may be outages for maintenance, faults or reasons beyond our control. We may improve, change or withdraw features. If a change takes away something essential of what you pay for, we will tell you and you can cancel; if we withdraw it during a paid period, we will refund the proportional part.

If we ever stop providing the service, we will tell you in advance.

12. Liability

We are responsible for providing the service in line with these terms and the law. Nothing in them limits the rights consumer law gives you, or our liability for wilful misconduct, gross negligence or personal injury.

To the extent the law allows, we are not liable for indirect damage (such as loss of profit), for what depends on third-party services beyond our control (your connection, your device, the app stores) or for use of Lexemica against these terms. If you are a business user rather than a consumer, our total liability is limited to what you paid in the previous 12 months.

13. Governing law and disputes

If you are a consumer, you always keep the protection of the mandatory rules of the country where you live and can go to its courts.

First of all, write to us: almost everything gets solved that way. You can also turn to the consumer or alternative dispute resolution bodies of your country.

14. Changes to these terms

We may update these terms, for example because of changes to the service or the law. We will update the date above and, if the change is significant, tell you in advance in the app or by email. If you don’t agree, you can stop using Lexemica, cancel Pro and delete your account; continuing to use it after the stated date means you accept them.

15. Contact

For any question about these terms, your subscription or a withdrawal: the Amberwake contact form, mentioning “Lexemica” in your message.
